Pegasus Wins Fees From 1000 Friends & Affirms Approval
Following our courtroom win in Oregon's Land Use Board of Appeals (LUBA), today we got payment for court fees from 1000 Friends of Oregon. It's not much - just $591 dollars for direct court fees - and much less than the amount we directly paid to our defense attorneys, but it is tangible proof of the frivolous nature of the lawsuit that fees were awarded at all.
Having successfully defended the approvals, Pegasus has now secured a 2-year timer from December 2022 to move forward in Oregon's Destination Resort process. This means the project's entitlements for the equestrian competition venue and resort are now affirmed by right. While this has added significant value to the property already, we are now unfortunately locked in issues to do with the original seller of the land - so the project continues to face delays.
We'd like to take this opportunity to reiterate that we are not against Oregon land use law or even against 1000 Friends. Without Oregon's clear and decisive process we could not have the certainty to move forward, and 1000 Friends in turn is critical for the enforcement and integrity of these land use laws. Oregon’s land use process protects agricultural uses, such as equestrian, from disappearing to suburban encroachment.
However, 1000 Friends is not a personal platform to be used to punish or prevent developments you simply dislike. Friends of Douglas County chose to abuse this process. If a development meets regulations, it should go forward as-of-right. Following our win here, we have gone some way of reminding them of this fact.
